Use of the Site

• You may use the Site for lawful business purposes.
• You may not interfere with the Site, probe or test its security, scrape it at volume, send automated or malicious submissions, misrepresent your identity, or use the Site to send spam.
• The contact form and the booking calendar are for genuine inquiries. We may decline or cancel any request.
• You must be at least 18 years old to use the contact form or book a call.

Content and intellectual property

The Site and its content (text, code, graphics, logos, data, the SGS name and marks) are owned by SGS or its licensors and protected by copyright, trademark and other laws. You may view and print pages for your own business evaluation. Any other use requires our written permission. Third-party names and logos shown on the Site belong to their owners and are used to identify them; their appearance does not imply endorsement.

Information on the Site

Content is provided for general information about our services. It is not professional, legal, financial or technical advice for your situation. Figures such as cost reductions, timelines and certifications reflect past engagements or current status and are not a guarantee of results. We may change content at any time without notice.

Third-party services and links

The Site uses or links to services operated by third parties (Microsoft Bookings, WhatsApp, LinkedIn, Cloudflare, Amplitude). Your use of those services is governed by their terms and privacy policies. We are not responsible for third-party sites or services.

Privacy

Our Privacy Policy and Cookie Policy explain how we handle personal data on the Site and form part of these Terms.

Disclaimer of warranties

The Site is provided "as is" and "as available". To the fullest extent permitted by law, SGS disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy and uninterrupted or error-free operation.

Limitation of liability

To the fullest extent permitted by law, SGS and its personnel will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from your use of the Site. Our total liability for all claims relating to the Site is limited to one hundred US dollars (USD 100). These limits do not apply to liability that cannot be limited under applicable law, including liability for fraud or wilful misconduct. Liability under a signed services agreement is governed by that agreement.

Indemnity

You will defend and hold SGS harmless from claims and costs arising from your breach of these Terms or misuse of the Site.

Electronic communications

By contacting us through the Site you agree that we may respond by email, phone, WhatsApp or video call and that electronic records of our communications satisfy any legal writing requirement, in line with Guatemala's Decree 47-2008 on electronic communications and signatures and applicable US law.

Governing law and disputes

These Terms are governed by the laws of the Republic of Guatemala, without regard to conflict-of-law rules. The courts of Guatemala City have exclusive jurisdiction, and you consent to that jurisdiction; SGS may also seek injunctive relief in any competent court. Before filing a claim, each party agrees to try to resolve the dispute in good faith by contacting the other within 30 days.

General

If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms, the Privacy Policy and the Cookie Policy are the entire agreement about use of the Site.
